Terms of use
Version 1.0 · valid from [launch date]
In short: Misaboard is free to use. Your documents stay on your device and belong to you. Measurements in Misaboard help you work — they do not replace checking them yourself. Swiss law applies; if you are a consumer, the protection of the country you live in stays with you.
1. Who we are and what these terms cover
These terms apply to the Misaboard app (Android, and later Windows, iPad and Mac), the website misaboard.com and any Misaboard account (together "Misaboard"). Misaboard is offered by [full name or company name, address, Switzerland] ("we", "us"). Contact: [email protected].
By installing or using Misaboard you accept these terms. If you use Misaboard for a company or another organization, you accept them on its behalf and confirm that you may do so.
2. What Misaboard is
Misaboard is a notebook and PDF editor: you can draw on pages and PDF plans, measure, scan paper, organize documents and export them. We develop Misaboard continuously: features may be added, changed or removed, especially while it is new. We will not remove features you rely on without a good reason and, where we can, we tell you in advance.
3. Free of charge
All features are free. If we ever offer paid plans, we will say clearly and in advance what costs money, the price and the conditions, and you decide freely whether you want them. Paid plans would get their own conditions, shown before you buy.
4. Your account
- You can use Misaboard without an account. Some functions (for example more than a certain number of exports, or using Misaboard on several devices) may ask for a free sign-in with Google or your email address.
- Give correct information and keep access to your account to yourself. Tell us if you think someone else uses it.
- You must be at least 16 years old to create an account, or have the consent of a parent or guardian.
- You can delete your account at any time in the app (Account → Delete account) or by writing to us. We then delete the data linked to it as described in the privacy policy.
5. Your documents and content
- Everything you create or import in Misaboard (drawings, notes, PDFs, scans, signatures) is yours. We claim no rights to it.
- Your documents are stored on your device. We do not receive, read or analyze them. You are responsible for keeping copies (for example with the export of PDFs or of whole spaces) — a lost or broken device can mean lost documents.
- Only import documents you are allowed to use, and respect the rights of others (copyright, data protection, confidentiality of plans).
6. Measurements, scale and professional use
Misaboard calculates lengths, areas, volumes and angles from the scale you set and from what is drawn or scanned. Results depend on the accuracy of the plan, the scan, the scale and your input. Misaboard is a tool that supports your work; it does not replace professional checking.
- Check every measurement and every quantity before you rely on it for planning, ordering, building, billing or contracts.
- Scans and photos can be distorted; plans printed or exported at another size change the scale.
- You remain responsible for decisions you make with the help of Misaboard and for the documents you share or sign.
7. What you may and may not do
We grant you a personal, non-exclusive, non-transferable right to use Misaboard for private and professional purposes, for as long as you follow these terms. You may not:
- copy, sell, rent or distribute the app, or offer it as part of another product;
- decompile, disassemble or otherwise try to obtain the source code, unless the law expressly allows this;
- get around limits, security measures or the sign-in, or access our servers in an automated way that puts them under load;
- use Misaboard for anything illegal, or to store or spread content that violates the rights of others.
Misaboard contains open-source components (for example PDFium and Flutter); their own licenses apply to them and are listed in the app (Account → Open-source licenses).
8. Availability
The app works offline. Online services (account, sign-in, website) may sometimes be unavailable, for example for maintenance or because of problems with providers. We take care to keep them running, but cannot promise that they always will.
9. Warranty
Misaboard is provided free of charge "as is". To the extent the law allows, we give no warranty that Misaboard is free of errors, suits a particular purpose or runs without interruption. Mandatory rights you have as a consumer are not affected.
10. Liability
We are liable without limitation for damage we cause intentionally or through gross negligence, and for injury to life, body or health. Otherwise, and as far as the law permits, we are not liable — in particular not for slight negligence, for loss of data or documents, for lost profit, or for indirect or consequential damage, including damage from measurements or calculations that were not checked (section 6). Mandatory liability under consumer protection or product liability law stays unaffected.
11. Services of others
Downloads, updates and purchases through an app store (for example Google Play) are governed by that store's terms. Sign-in with Google is governed by Google's terms. We are not responsible for these services.
12. Ending
You can stop using Misaboard at any time and delete the app and your account. We may suspend or close an account if it is used against these terms or the law, after a warning where reasonable. Sections 5, 6, 9, 10 and 14 continue to apply after the end.
13. Changes to these terms
We may change these terms, for example for new features or new laws. We announce important changes in the app or on this page at least 30 days before they take effect. If you do not agree, you can stop using Misaboard and delete your account; if you keep using it after that date, the new terms apply.
14. Law and courts
These terms are governed by Swiss law, excluding the UN Convention on Contracts for the International Sale of Goods (CISG) and the rules on conflicts of laws. The courts at our registered seat in Switzerland have jurisdiction. If you are a consumer living outside Switzerland, the mandatory consumer protection of your country of residence remains applicable, and you may also go to the courts there.
15. Final provisions
If a provision of these terms is invalid, the rest remains valid; the invalid provision is replaced by one that comes closest to its purpose and is valid. These terms are written in English; translations are for convenience, the English version prevails.
